This website is operated by Dusk Studios. Throughout the site, the terms "we", "us" and "our" refer to Dusk Studios, a sole trader established in the Czech Republic.

These Terms govern your use of our website and the purchase of products offered through our online store (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. How we handle your personal data is described in our Privacy Policy. Nothing in these Terms limits mandatory consumer rights under applicable law.

We make every effort to display our products accurately. However, colours and appearance may vary depending on your device settings. Product descriptions and availability may change without notice.

3. Orders and contract formation

By placing an order, you submit an offer to conclude a purchase contract. The contract is concluded once we confirm acceptance of your order. We reserve the right to refuse or cancel an order in case of obvious pricing errors, suspected fraud or product unavailability. Purchases are intended for personal use only and not for resale.

4. Prices and payment

All prices displayed in the store are final prices. The seller is not a VAT payer under Czech law. Shipping is free. Payment must be made using the payment methods offered at checkout. We reserve the right to correct obvious pricing errors.

5. Shipping and delivery

Delivery times are estimates and are not guaranteed. The risk of loss or damage to the goods passes to you at the moment you (or a third party you designate) take physical possession of the goods. We are not liable for delays caused by shipping carriers or events beyond our reasonable control. More details are in our Shipping policy.

6. Right of withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason. Full details of the withdrawal process are provided in our Returns & refunds policy.

7. Rights from defective performance

If goods are defective upon delivery, consumers are entitled to exercise their rights from defective performance in accordance with applicable Czech law. Consumers may exercise their rights regarding defective goods within 24 months from receipt of the goods, unless otherwise provided by law. This section does not affect the right of withdrawal.

8. Intellectual property

All content on this website, including but not limited to text, images, graphics, logos and product designs, is the property of Dusk Studios or its licensors and is protected by intellectual property laws. No content may be reproduced, distributed or used without prior written consent.

9. Third-party services

Payments are processed by Stripe. Hosting, website delivery, email and shipping are provided by the third parties listed in our Privacy Policy. We are not responsible for third-party services beyond our control.

10. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect or consequential damages arising from the use of our Services. Nothing in these Terms limits or excludes liability that cannot be limited under applicable law. Mandatory consumer protection rights remain unaffected.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Czech Republic. If you are a consumer residing in another EU Member State, you also benefit from the mandatory consumer protection provisions of your country of residence.

If a consumer dispute cannot be resolved with us directly, you can turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, adr.coi.cz) for out-of-court resolution.

12. Changes to these Terms

We reserve the right to update these Terms at any time. The version published on the website at the time of your order applies to your purchase.
