This website is operated by dusk studios. Throughout the site, the terms “we”, “us” and “our” refer to dusk studios, operated by Vanesa Dušková, a sole trader established in the Czech Republic.

These Terms of Service govern your use of our website and the purchase of products offered through our online store (the “Services”). By accessing or using our Services, you agree to be bound by these Terms and by our Privacy Policy. Nothing in these Terms limits mandatory consumer rights under applicable law.

SECTION 2 – PRODUCTS

We make every effort to accurately display our products. However, colors and appearance may vary depending on your device settings. Product descriptions and availability may change without notice.

SECTION 3 – ORDERS AND CONTRACT FORMATION

By placing an order, you submit an offer to conclude a purchase contract.The contract is concluded once we confirm acceptance of your order. We reserve the right to refuse or cancel an order in case of obvious pricing errors, suspected fraud, or product unavailability. Purchases are intended for personal use only and not for resale.

SECTION 4 – PRICES AND PAYMENT

All prices displayed in the store are final prices. The seller is not a VAT payer under Czech law. Shipping costs are displayed during checkout before the order is completed. Payment must be made using the payment methods offered at checkout. We reserve the right to correct obvious pricing errors.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates and are not guaranteed.The risk of loss or damage to the goods passes to the customer at the moment the customer (or a third party designated by the customer) takes physical possession of the goods. We are not liable for delays caused by shipping carriers or events beyond our reasonable control.

SECTION 6 – RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from the contract within 14 days without giving any reason. Full details of the withdrawal process are provided in our Return & Refund Policy.

SECTION 7 – RIGHTS FROM DEFECTIVE PERFORMANCE

If goods are defective upon delivery, consumers are entitled to exercise their rights from defective performance in accordance with applicable Czech law. Consumers may exercise their rights regarding defective goods within 24 months from receipt of the goods, unless otherwise provided by law. This section does not affect the right of withdrawal.

SECTION 8 – INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, images, graphics, logos, and product designs, is the property of dusk studios or its licensors and is protected by intellectual property laws.No content may be reproduced, distributed, or used without prior written consent.

SECTION 9 – THIRD-PARTY SERVICES

Our store is powered by Shopify. Payments and technical services may be processed by third-party providers. We are not responsible for third-party services beyond our control.

SECTION 10 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, we are not liable for indirect or consequential damages arising from the use of our Services. Nothing in these Terms limits or excludes liability that cannot be limited under applicable law. Mandatory consumer protection rights remain unaffected.

SECTION 11 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic.If you are a consumer residing in another EU Member State, you also benefit from mandatory consumer protection provisions of your country of residence.

We reserve the right to update these Terms at any time.
